The Territories Policy requires consultants to work only within their assigned territories. Consultants must not call outside their assigned territory for marketing or pursuing job orders, but they may be allowed to work on job orders outside their territory with the approval of Charlie Kimmel. The policy also indicates that relationships will normally be honored, and a split commission solution will be worked out with another consultant if necessary. The consultants are not allowed to recruit outside of their marketplace, and placing a candidate outside the assigned territory without approval may result in automatic commission loss or termination.
Spirit of the Territory:
A consultant should pursue work only within their assigned territory. If you are led outside of your assigned territory, you may still be able to work the search but must have the approval of Kimmel & Associates.
Rules:
- Calling outside your assigned territory in order to market a candidate or pursue a job order is forbidden.
- If you are led outside your territory (for any reason) on a job order lead, you are required to get the approval of Charlie Kimmel in order to pursue it.
- At his discretion, generally decided by what is best for the client, he may allow you to work the search or re-assign it to the individual in whose assigned territory it is.
- Relationships will normally be honored; for example, if your hiring authority moves or is transferred into someone else’s territory.
- Production and past history may play a role in the decision.
- Optimally a split commission solution will be worked out with another consultant.
- Consultants are not allowed to recruit outside of their marketplace. It is the sole responsibility of the consultant to know who the clients are in each marketplace.
Repercussions
If you place a candidate outside of your marketplace, without approval, it is possible that the commission will automatically go to the consultant in whose marketplace the placement was made.
Termination is also a possibility.
